Terms of Service
Last updated: 30 September 2026
Effective date: 6 October 2026
LocaYo keeps evolving — we regularly add new features and improvements, and the Platform is under continuous development. This means individual features may be in active development, work with a limited scope, or temporarily malfunction. If you come across a feature that does not work as it should — report it via the contact form — we treat such reports as a priority. The current version of these Terms is always available on this page; we give advance notice of material changes (see Section 17 for details).
This version of the Terms applies from 6 October 2026 and adds the Local classifieds section (§ 7b). What is changing · Terms in force until 5 October 2026
1. Introduction and Acceptance
- These Terms of Service ("Terms") govern your use of the LocaYo platform available at locayo.app and through our mobile applications (collectively, the "Platform" or "Service").
- The Platform is operated by Next Orbit OÜ ("LocaYo", "we", "us", or "our"), a private limited company (osaühing) registered in the Republic of Estonia, registry code 17501338, registered address: Sepapaja 6, 15551 Tallinn, Estonia. For data protection matters, you can reach us at [email protected].
- You can contact us via our Help Centre contact form or by email at [email protected].
- By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and Cookie Policy. If you do not agree, please do not use our Service.
- These Terms are made available free of charge on the Platform in a format that allows you to download, reproduce, and store them.
- These Terms apply to users in the European Union member states and the European Economic Area. Specific regional provisions are noted where applicable.
2. Definitions
- "User" means any person who accesses or uses the Platform, whether registered or not.
- "Account" means a registered user account on the Platform.
- "Listing" means an advertisement for rental of goods, provision of services, or rental of spaces published on the Platform.
- "Local classified ad" means an ad for the sale, swap or giving away of an item, as well as for the sale or lease of real estate, the sale of a vehicle or a job offer, published in the Local classifieds section (§ 7b). A Local classified ad is not covered by the Booking system.
- "Provider" means a User who offers goods for rental, provides services, or offers spaces for rent through the Platform.
- "Customer" means a User who rents goods, uses services, or rents spaces through the Platform.
- "Booking" means a reservation request or confirmed arrangement between a Provider and a Customer.
- "Services" (when referring to Provider offerings) means any services offered by Providers through the Platform, including but not limited to tutoring, photography, repairs, pet care, cleaning, and other local services.
- "Rental" means the temporary use of goods or spaces offered by a Provider to a Customer.
- "Boost" means a paid premium feature that increases the visibility of a Listing on the Platform.
- "Tax Identification Number" or "TIN" means a unique identification number issued by a tax authority to identify a taxpayer, including (but not limited to) a National Insurance Number (UK), PESEL or NIP (Poland), Steuer-IdNr (Germany), or equivalent identifier in the Provider's country of tax residence.
3. Nature of Our Service
- LocaYo is a marketplace platform that connects Providers with Customers. We enable Users to discover, communicate about, and arrange rentals and services and, in the Local classifieds section, to advertise items for sale, swap or to give away.
- We are not a party to transactions. Any agreement for rental of goods, provision of services, or rental of spaces is made directly between the Provider and Customer, and contracts arising from Local classified ads (sale, exchange, donation, lease) are made directly between Users.
- We do not process, handle, or intermediate payments between Users. All payments for rentals, services and items from Local classified ads are arranged directly between Users by whatever method they agree upon (cash, bank transfer, or other payment methods). LocaYo does not charge transaction fees or commissions on rentals, services or sales.
- We may offer paid premium features. LocaYo may offer optional paid features such as Boosts (increased Listing visibility) and other premium services. Payments for these features are made directly to LocaYo via our payment processor (Stripe) and are subject to applicable taxes including VAT.
- We do not own, rent, or provide any of the items, services, or spaces listed on the Platform. Providers are independent individuals or businesses.
- We do not verify the quality, safety, legality, or availability of any listings. Users interact at their own risk.
- The Platform facilitates:
- Rental of physical goods (tools, equipment, vehicles, etc.)
- Provision of services (tutoring, repairs, photography, etc.)
- Rental of outdoor spaces (parking, storage, event venues)
- Rental of camping equipment and outdoor spots in the Accommodation category (campers, caravans, tents, glamping, campsite spots, boats — see § 3b)
- Local classifieds: for sale, swap, free to collect — including real estate, vehicles and job offers (in accordance with § 7b)
- Communication between Users via our messaging system
- Booking management and availability calendars
- Job board (requests). A Client may post a service request, and matching Service Providers may apply with an in-app message. Use of the job board is free. LocaYo does not guarantee that any Service Provider will respond to a request, nor does it verify the content of applications. Contact details (phone number) are shared mutually only after the Client selects a specific Service Provider — until then, communication happens solely through in-app chat. Selecting a Service Provider does not create a contract with LocaYo; any arrangements, quotes and payments are made directly between the Client and the Service Provider (per paras. 2–3 above).
- What the Platform does not support. The LocaYo Booking system serves short-term rental of items and spaces and provision of services only; selling, swapping and giving away items takes place solely in the Local classifieds section (§ 7b), without Bookings. The following activities are explicitly prohibited and will not be published on the Platform:
- Sale of items in rental or service listings — items for sale are listed solely as a Local classified ad (§ 7b).
- Short-term rental of residential dwellings — rental of apartments, flats, single-family homes, rooms in residential apartments and other "units" within the meaning of Article 3(1) of Regulation (EU) 2024/1028 of the European Parliament and of the Council. See § 3b. For short stays in residential dwellings, use Airbnb, Booking.com or Vrbo.
- Long-term residential lease in the Booking system — rental of residential property for more than 30 days, in particular residential lease within the meaning of national tenant-protection laws (e.g. Polish Act on the Protection of Tenant Rights of 21 June 2001, Estonian Võlaõigusseadus § 271 et seq.), may not be the subject of a Booking or of a rental listing. Such an offer may be posted solely as a Local classified ad in the Real estate section (§ 7b para. 8).
- Hospitality business — commercial accommodation operations in hotels/hostels (NACE 55.1/55.2) require a separate registration infrastructure that LocaYo does not support.
- Content from external sources. Besides listings added manually by Users, the Platform displays content fetched automatically from other systems. Each such item states its source:
- Public tenders — contract notices from the Polish Public Procurement Bulletin (e-Zamówienia platform, Public Procurement Office) and from the Competitiveness Database (Baza Konkurencyjności, Ministry of Development Funds and Regional Policy), shown next to private job requests with the source and retrieval date. We present selected fields of a notice for information only: the text published by the contracting authority is binding, and bids are submitted directly to it, outside LocaYo. We are not a party to the procedure and do not guarantee that this data is complete or up to date. The full list of tenders is visible to logged-in Users with a business card (§ 7a); publicly we show only the number of notices.
- Developer investments — flat prices from the public register of developer prices (dane.gov.pl), shown in the Real estate section with the source stated. Contact leads directly to the developer; LocaYo chat is disabled for these entries. We are not the author of this data and are not responsible for keeping it current.
- Real estate agency offers from their software (CRM) — an agency may have its offers sent automatically to the Real estate section. Such offers are published on the agency's account with the label "Real estate agency", go through the same moderation as Local classifieds, and the agency is responsible for their content as for a listing added manually (§ 7b). An offer expires when the agency removes it in its software; if the agency sends no data for 30 days, all of its imported offers expire.
3a. Ranking transparency (P2B)
Under EU Regulation 2019/1150 (P2B), LocaYo discloses the main parameters determining the order of listings in search results and category pages, and their relative importance.
- Main ranking parameters (in decreasing weight):
- Active paid boosts — these work differently depending on the type, for the duration of the boost:
- Homepage — the listing enters a rotating pool with a limited number of slots at the top of the homepage, and includes the effect of Top in category. When it does not currently fit into the pool, it is shown in the regular rotation. In the homepage “All” view the pool covers both rental listings and Local classified ads with this boost, and the remaining listings of both kinds are shown alternately.
- Top in category — the listing is shown ahead of non-promoted listings in category lists and in search results.
- Bump — increases how often the listing is drawn in the rotation. It does not guarantee any specific position.
- Highlight — changes only the appearance of the listing card and does not affect ordering.
- Query relevance — match of search phrase against title, description, category, tags, and location.
- Geographic distance — closer listings rank higher when the User has location or a distance filter enabled.
- Provider rating and trust — average rating, number of completed bookings, account signals (confirmed email, phone number provided, identity).
- Freshness and completeness — these matter when the User selects sorting by date; in the default rotation, the publication date does not raise a listing's position.
- Availability — listings with a scheduled calendar and free slots are preferred.
- Active paid boosts — these work differently depending on the type, for the duration of the boost:
- Labelling of paid promotion: listings with the Highlight, Top in category or Homepage boost carry a coloured frame on the card — a distinct colour for each of these three boosts. The Bump boost does not change the appearance of the listing and is not separately labelled on the card; it only affects how often the listing is drawn in the rotation, which we disclose in this clause and in the promotion descriptions available in the User panel ("Promotions" tab).
- No other commercial factors affect ranking. LocaYo does not charge transaction commissions on rentals — there is no mechanism by which a higher commission would lift a listing's position. The only payments Providers make to LocaYo are for optional boosts (highlights) and subscription packages (Bronze/Silver/Gold).
- Professionals directory: the default order of business cards in the professionals directory is random (rotational) — every business receives equal exposure and the order changes cyclically. Sample profiles (labelled "Sample profile") are always displayed below the cards of real businesses. Users can switch the sorting themselves (distance, ratings, completed jobs, date added). A position in the professionals directory cannot be bought.
- Local classifieds (§ 7b): unlike rental and service listings, they do not rotate — the default order is chronological (newest first), and a free renewal of validity does not change the position. In search, what counts is how well the query matches the kind of item, brand, title and description; the User may choose sorting by price. Paid boosts work here as follows: Bump moves the ad to the top of the chronological list as if it had just been published; Top in category and Homepage display it ahead of non-boosted ads for the duration of the boost; Highlight changes only the appearance of the card. Local classified ads are not covered by subscription plans. We make boosts available in this section gradually.
- These parameters may be modified. Any material change to the main ranking parameters will be announced at least 15 days before taking effect, except where the change addresses an urgent legal or security risk (P2B Art. 5(3)).
- Ranking contact: questions about how the ranking works or about a specific listing's position can be directed to [email protected]. We respond within 15 business days (P2B Art. 11 — internal complaint-handling system).
3b. Accommodation category and compliance with Regulation (EU) 2024/1028
Due to the structure of its listing categories and the prohibition on listing short-term residential rentals, LocaYo does not provide an "online short-term rental platform" servicewithin the meaning of Article 3(4) of Regulation (EU) 2024/1028 of the European Parliament and of the Council of 11 April 2024 on data collection and sharing relating to short-term accommodation rental services.
- Permitted scope. In the "Accommodation" category, LocaYo accepts only Rental Items explicitly excluded from Regulation (EU) 2024/1028 under:
- Article 3(1)(b) — accommodation in camping grounds, recreational vehicle parks and trailer parks (NACE Rev. 2 group 55.3);
- Recital (7) of the preamble — "tents, caravans or recreational vehicles".
- Prohibited scope (§ 7). Listing a short-term rental of an apartment, flat, single-family home, studio, room in a residential apartment, bungalow permanently attached to land, holiday home for stay, or any other "unit" within the meaning of Regulation (EU) 2024/1028 is prohibited.
- Pre-publication verification. Providers listing in the "Accommodation" category:
- select an exact item type from the list (camper, tent, glamping, campsite spot, etc.),
- accept a declaration that the listed item is NOT a residential dwelling within the meaning of Regulation (EU) 2024/1028 nor of Polish CWTON rules,
- the declaration is timestamped with date, IP and version; it is subject to LocaYo audit.
- Auto-moderation. Listings in the "Accommodation" category are scanned for keywords indicating a residential dwelling (e.g. "apartment", "flat", "bedroom", "kitchen", "balcony" and equivalents in 21 other Platform languages). Flagged listings are reviewed manually by the LocaYo team. Listings violating clause 2 are removed without refund of promotion fees, with notice to the Provider.
- Host liability. Providers violating clause 2 bear full responsibility for the consequences of such violation, in particular administrative fines (up to PLN 50,000per Article 16(1) of the draft Polish Act on Short-Term Rental, parliamentary bill 2353; proponent: MP Kamil Wnuk, Poland 2050 club; first reading 17 April 2026).
- CWTON number (reserved). If the Polish Central Register of Tourist Accommodation (CWTON) or an equivalent registry in another EU Member State becomes operational, or if competent authorities change the interpretation of Regulation (EU) 2024/1028, LocaYo reserves the right to amend these Terms, including adding an obligation for Providers to provide a CWTON identification number. Any material change to the "Accommodation" category scope will be announced with at least 15 days' notice.
- Cooperation with authorities. LocaYo cooperates with competent national authorities to the extent required by Article 14 of Regulation (EU) 2024/1028 and applicable national legislation.
- More information. Detailed guidance, host FAQ and examples of accepted/rejected listings: Help Center — Accommodation category.
4. Eligibility and Registration
- Minimum age requirements:
- You must be at least 16 years old to create an account and use basic Platform features.
- You must be at least 18 years old to become a Provider and offer listings.
- Users aged 16-17 may use the Platform as Customers only, with parental or guardian consent.
- Providers may set their own additional age requirements for specific items or services (e.g., 21+ for vehicle rentals).
- By registering, you confirm that you meet the applicable age requirements and have the legal capacity to enter into binding contracts (or have parental consent if aged 16-17).
- You may register as an individual or as a business. Business accounts have additional features.
- Signing in with an external provider (Google, Facebook). By creating an account or signing in with Google or Facebook you authorise us to obtain from your account with that provider: your first name, last name, email address, profile picture and account identifier. Publicly on the Platform only your first name (or the username you chose) and your profile picture are visible — we do not publish your last name or email address. You can change the public name and remove the picture in your account settings at any time.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may not create multiple accounts, use another person's account, or transfer your account to others.
- We reserve the right to verify your identity and may require additional documentation.
- Account notifications. By creating an account you agree to receive notifications related to your use of the Platform (including bookings, messages, job requests, the status of your listings and business profile, and account security) in the app, by e-mail and as push notifications. You can switch off any of these channels at any time in your account settings; messages necessary for the operation of your account (e.g. login codes, notices of changes to these Terms) are sent regardless of those settings. Marketing content requires separate consent.
5. User Obligations
5.1 General Obligations
- Use the Platform in compliance with these Terms and applicable laws.
- Provide accurate and truthful information in your profile and listings.
- Communicate respectfully with other Users.
- Not use the Platform for any illegal, fraudulent, or harmful purposes.
- Report any violations, suspicious activity, or safety concerns to us.
- Register with your own permanent e-mail address. Accounts on disposable inboxes, accounts using someone else's or fictitious details, and creating multiple accounts to get around restrictions, a block or bonuses are not allowed.
- Do not collect content or data from the Platform by automated means (bots, scrapers, bulk copying of listings and User data). This does not apply to search engines acting in accordance with the robots.txt file.
- Do not send other Users links to external websites — messages containing such links are not delivered. Do not impersonate LocaYo: LocaYo never asks in chat for “account verification”, card details or signing in through a link sent to you.
5.2 Provider Obligations
- Ensure you have the legal right to rent items, provide services, or rent spaces you list.
- Provide accurate descriptions, photos, and availability information.
- Maintain items in safe, working condition and provide services with reasonable care and skill.
- Respond to booking requests promptly.
- Honour confirmed bookings unless exceptional circumstances apply.
- Comply with all applicable laws, including tax obligations, consumer protection laws, and any licensing requirements for services you provide.
- If offering services, ensure you have appropriate qualifications, insurance, and certifications where required by law. Examples of regulated services include:
- UK: Gas Safe registration (gas work), Part P certification (electrical), DBS checks (childcare), ADI licence (driving instruction)
- EU/EEA: Relevant trade certifications, professional licences as required by local law
- You may set your own age restrictions for specific listings where appropriate.
5.3 Provider Tax Compliance Obligations
LocaYo is classified as a Reporting Platform Operator under EU Council Directive 2021/514 (DAC7) as implemented in Estonian law. As a company registered in Estonia, our lead tax authority is the Estonian Tax and Customs Board (Maksu- ja Tolliamet). We are legally required to collect certain information from Providers and report it to tax authorities.
- Mandatory information. Providers must provide the following information accurately and promptly when requested:
- Full legal name (and business name, if applicable)
- Date of birth (for individuals)
- Primary address
- Country of tax residence
- Tax Identification Number (TIN) issued by each country of tax residence
- Business registration number (for business accounts, if applicable)
- VAT identification number (if applicable)
- Accuracy and updates. Providers are responsible for ensuring that the information they provide is accurate, complete, and up to date. You must promptly notify us of any changes to your tax compliance information.
- Consequences of non-compliance. If a Provider fails to provide the required tax information within 60 days of the initial request (following two reminders), LocaYo may:
- Restrict the Provider from creating new Listings
- Temporarily hide or deactivate existing Listings
- Suspend delivery of paid premium features (e.g. active boosts) until the information is provided
- Suspend the Provider's account until the required information is provided
- Reporting to tax authorities. LocaYo is legally obligated to report Provider information (including personal details, TIN, and transaction data such as the total value of bookings and number of transactions) to the Estonian Tax and Customs Board (Maksu- ja Tolliamet), which exchanges this data with the tax authorities of the Provider's country of tax residence under DAC7 automatic exchange of information provisions. This reporting is a legal obligation and does not require separate consent. For more details, see our Privacy Policy.
- Notification. LocaYo will notify each Provider of the information that has been reported to tax authorities in respect of them, in accordance with applicable regulations.
- Provider's own tax obligations. LocaYo's reporting obligations do not replace or reduce your own tax obligations. You are solely responsible for declaring income, paying taxes, and complying with all tax laws applicable in your jurisdiction. We recommend seeking independent tax advice.
- Tax-related content is general information. Thresholds, limits and rates shown on the Platform (including information pages, the Help Centre and the blog) relate to Polish law and reflect the legal position as at the date of publication. Tax rules change, and other countries apply their own thresholds and obligations. This content is also provided in translation into the other languages of the Service — in the event of any discrepancy, the Polish version of that content prevails. It does not constitute tax, legal or accounting advice and must not be relied upon without your own verification. Before you start earning, verify the applicable thresholds and obligations yourself with your competent tax authority or an adviser.
5.4 Customer Obligations
- Use rented items responsibly and return them in the same condition.
- Pay agreed amounts directly to Providers by the agreed method.
- Report any damage or issues immediately.
- Return items on time or notify Providers of any delays.
- Respect Provider property and the spaces where services are provided.
- Meet any age or other requirements set by individual Providers.
6. Insurance and Liability Between Users
- LocaYo does not provide insurance. We do not offer any insurance coverage for items, services, or spaces listed on the Platform.
- Provider insurance: Providers are strongly encouraged to:
- Have appropriate insurance for items they rent out
- Hold professional indemnity insurance if providing services
- Check that their home/contents insurance covers peer-to-peer rentals
- Consider public liability insurance
- Customer responsibility: Customers are responsible for:
- Any damage to rented items during the rental period
- Returning items in the same condition as received
- Compensating Providers for damage, loss, or late returns as agreed
- Deposits: Providers may require security deposits. Any deposits are arranged directly between Users — LocaYo does not hold or process deposits.
- We recommend Users discuss insurance and liability before confirming bookings.
7. Listings
- Providers may create listings for goods available for rent, services they offer, or spaces available for rent.
- All listings must:
- Be accurate, truthful, and not misleading
- Include clear photos (where applicable)
- Specify pricing, availability, and any conditions
- Note any age restrictions or requirements
- Not infringe third-party rights
- Comply with all applicable laws
- Prohibited listings include but are not limited to:
- Sale offers for items posted outside the Local classifieds section (§ 7b)
- Long-term residential lease exceeding 30 days posted outside the Real estate section of Local classifieds (see § 3 para. 9 and § 7b para. 8)
- Illegal items or services
- Weapons, drugs, or controlled substances
- Counterfeit or stolen goods
- Adult content or services
- Services requiring professional licences you do not hold
- Items that pose safety risks
- Anything that violates third-party rights
- Ban on contact details in listing content. Listings must not include in their title, description, or images:
- phone numbers (including spelled out or obfuscated),
- email addresses (including obfuscated with "at"/"dot" tricks),
- URLs or external domain names (links to other locayo.app subpages excepted),
- third-party messenger handles (WhatsApp, Telegram, Signal, Viber, Messenger, Skype, Discord, etc.),
- exact property/pickup address before a booking is confirmed.
Pre-booking communication between Providers and Customers must take place exclusivelythrough the in-platform LocaYo chat and booking system. After a booking is confirmed, the necessary contact data is shared between the parties in a controlled manner — see § 8.7.
Why this ban: protecting Users against abuse and scams, preserving conversation history for LocaYo support intervention, data-protection compliance, and preventing circumvention of the Platform's booking flow.
A Listing containing such data goes to moderation. The moderator may reject it or ask for a correction; we inform you of the decision and its reason in the panel and by e-mail, and a corrected Listing returns to moderation. Repeated attempts may lead to account restrictions or suspension pursuant to § 15.
- We may remove a Listing that violates these Terms. We inform the owner of the removal and its reason in the panel and by e-mail; the decision can be appealed via the contact form (§ 15).
- Free accounts have limits on the number of active listings. Premium features (such as Boosts) may be available for additional visibility.
- Phone number in a listing. When creating a listing, the Provider decides whether to share their phone number in it. If they do, the number is not visible in the listing content; we show only a preview (e.g. "+48 500 ••• •••") and release the full number once a logged-in User deliberately clicks "Show number". The number of reveals is subject to anti-spam limits and each one is counted in the listing statistics. If the Provider does not consent, contact happens solely through in-app chat. The setting can be changed at any time by editing the listing.
- Listing statistics. In the dashboard the Provider sees aggregate data about their listings: the number of views, number reveals, conversations started and bookings, plus how visitors reached the listing and what type of device they used. We do not give them data that identifies an individual visitor — neither identity, nor IP address, nor browsing history.
7a. Professionals Directory and Business Cards
- A professional's business card is a free, public presentation of a Provider's business in the professionals directory (the "Professionals" section): name, description, specialisations, service area, opening hours, photos of completed work and contact details.
- By publishing a business card, the Provider declares that the information provided is true and that they are authorised to represent the presented business. The Provider is solely responsible for the content of the business card.
- Business card data is public. The phone number is not present in the page content — it is revealed only after a logged-in User deliberately clicks "Show number"; the number of reveals is subject to anti-spam limits.
- Verification badges (e.g. liability insurance, certificates) are granted only after positive verification of documents. Verification is optional and is not a condition of being present in the directory.
- Sample profiles, labelled "Sample profile", exist solely to demonstrate the directory's capabilities — they do not belong to real businesses, contain no contact details and are excluded from search-engine indexing.
- LocaYo may prepare a draft business card based on publicly available company data and offer the business owner the option to claim it via a dedicated link. A draft is not public until claimed; the owner may request its deletion.
- We reserve the right to hide or remove a business card that violates these Terms, applicable law, or contains misleading information.
7b. Local classifieds — for sale, swap, free to collect
- What this section is. Local classifieds is a board where Users list items for sale, for swap or to give away for free, and — in the Real estate and Vehicles sections — also real estate (sale, exchange, lease) and vehicles, and in the Jobs section — job offers. The section is separate from item rentals, services and the job-request board: the Booking system, the calendar and Platform-generated agreements do not operate here. The provisions of § 7 apply to Local classifieds unless this paragraph states otherwise. We may open individual sections gradually. We do not publish "wanted" or "looking for" ads.
- LocaYo is not a party to the contract. Any sale, exchange, donation or lease contract is concluded solely between Users, outside the Platform. LocaYo does not take part in concluding, performing or settling these contracts and does not know their final terms: it does not accept payments, hold money or items, or arrange shipping, and it does not run a buyer-protection programme. We recommend collection in person and payment after inspecting the item. Do not send deposits to strangers and do not use "payment collection" links sent in messages — LocaYo never sends such links.
- Who is advertising. When posting a Local classified ad, the User declares whether they act as a private individual or as a trader (including a real-estate agent, developer, used-car lot or dealer). We show this information next to the ad. Where the seller is a private individual, the buyer does not benefit from consumer rights arising from rules on contracts concluded with a trader (in particular the right of withdrawal from a distance contract); the seller's liability follows from the Civil Code. A trader is responsible for meeting their own information duties towards consumers and for the safety of the products offered — they may not offer dangerous products or products withdrawn from the market. Reports concerning product safety (the "Report this ad" button or [email protected]) are handled first, no later than within 3 working days. The User is responsible for the truthfulness of the declaration; posing as a private individual while trading commercially is a breach of the Terms.
- Fees and Boosts. Posting Local classified ads is free of charge and does not count towards the plan limits in § 9. A User may voluntarily use paid Boosts (Bump, Highlight, Top in category, Homepage) under the rules and prices in § 9 and the price list shown before purchase; we make these features available in individual sections gradually. The price of a Boost is always shown before purchase, a change of the price list does not affect Boosts already paid for, and we announce price increases with the notice period set out in § 17. Not using Boosts does not restrict publication of an ad. Introducing a fee for merely posting an ad in a selected section would require an amendment of the Terms under § 17.
- Requirements. A Local classified ad contains a truthful title and description, a price (or the "free" or "swap" marking), a town and up to 8 photos showing the item actually offered. One item means one ad. Posting the same ad multiple times (spam) — including in different towns or sections, or by deleting and re-posting it to return to the top of the list — is prohibited and may result in removal of the ads and blocking of the Account (§ 15). The number of ads per Account is not limited; for anti-spam reasons we may apply daily limits on the number of new ads (lower for new Accounts), and an ad posted in place of a recently deleted ad with the same content keeps that ad's previous position on the list.
- What may not be advertised. In addition to the prohibitions in § 7 para. 3, in this section we do not publish in particular:
- dogs and cats other than under para. 7, and animals covered by species protection,
- medicines, prescription medical devices and supplements with medicinal effect,
- drugs, psychoactive substances and "legal highs",
- weapons, ammunition, explosives and pyrotechnics,
- alcohol, tobacco products, e-cigarettes and e-liquids,
- documents, accounts, login credentials and SIM cards registered to another person,
- counterfeits, copies and goods infringing intellectual-property rights,
- services and content of an intimate nature,
- stolen items and devices with a lock (iCloud, MDM, IMEI blacklist),
- products withdrawn from the market or found to be dangerous.
- Animals. Polish law prohibits placing dogs and cats on the market outside their place of keeping or breeding, and breeding them for commercial purposes outside kennels and catteries registered with nationwide breeders' organisations (Art. 10a of the Animal Protection Act). Therefore:
- the sale of a dog or cat may be advertised only by a kennel or cattery registered with such an organisation — any nationwide breeders' association or union, not only the largest ones; the ad states the name of the kennel or cattery and the full name and number (REGON or KRS) of the organisation it is registered with; the animal is handed over at the place of breeding, with no "delivery" or shipping,
- adoption of a dog or cat (free of charge) may be advertised only by animal shelters and social organisations whose statutory purpose is animal protection; we do not publish "dog / cat to give away" ads from other persons,
- one ad concerns one animal or one litter; an animal may not be a "free extra" with another item or the subject of a swap,
- ads for other live animals are always reviewed by a moderator; we do not publish animals covered by species protection.
- Real estate. In the Real estate section you may advertise sale, exchange and lease other than short-term (flats, houses, rooms, plots, garages, commercial premises, halls and warehouses). An ad is solely information about an offer — the Platform does not handle bookings, payments or lease agreements for real estate. Short-term rental of residential premises remains prohibited in this section as well (§ 3b). Where an energy performance certificate has been issued for the building or premises, the advertiser is required by law to state the indicators from that certificate in the ad — the form provides separate fields for this and the advertiser is responsible for filling them in. Agents and developers advertise as a trader. One ad concerns one property and one type of transaction (not "for sale or to let"); the price stated is the price of the whole property or, for a lease, the monthly rent. An exact address is not required; the town and district are sufficient.
- Vehicles. In the Vehicles section you may advertise the sale and swap of vehicles, machinery, trailers, and parts and accessories. The advertiser states the true mileage, year of manufacture, technical condition and information about damage; advertising a vehicle with a false odometer reading is prohibited, as are auction-style ads. The form may require the VIN; we show it only after the interested person clicks to reveal it. Only a person entitled to dispose of the vehicle (the owner or a person authorised by the owner) may advertise it. Used-car lots and dealers advertise as a trader.
- Jobs. In the Jobs section employers and employment agencies may advertise job and contract-work offers. The ad states who is hiring (company name or the first name of the person hiring), the position, the place of work and the type of contract. The job title and the content of the ad must be gender-neutral and non-discriminatory (Art. 183ca of the Polish Labour Code); we recommend stating the pay or pay range. An employment agency states its entry number in the register of employment agencies. The following are prohibited: charging candidates any fees, offers conditional on a payment, the purchase of goods or recruiting further persons, offers of an escort nature, and offers of work that is against the law. We do not publish "looking for a job" ads. LocaYo is not an employment agency, does not conduct recruitment and does not collect CVs — contact with the advertiser takes place under the "Contact" paragraph below.
- Moderation. A Local classified ad becomes public after review by a moderator. The form rejects ads for goods on the prohibited list straight away and gives the reason (an automated keyword check); all other decisions are made by a moderator. A rejected ad returns to its author with the reason; once corrected, it is reviewed again. A change of title, description or photos may send the ad back to moderation; a change of price does not. Decisions may be appealed (§ 15).
- How long an ad lives. A Local classified ad is active for 45 days from publication and — unless the Author switches this off — is renewed automatically for a further 45 days. We may limit the number of consecutive automatic renewals; once it is used up, and also in the last 7 days of the period and after it ends, the Author may renew the ad manually, free of charge. No renewal changes the ad's position on the list. The Author must promptly mark the ad as "sold" / "no longer valid" when it ceases to be current. After the period ends, or after the ad is marked as "sold" / "no longer valid", the ad remains available at its address for 14 days with a notice that it is no longer valid, and then disappears from the public part of the Platform.
- Order on lists. Local classified ads are displayed chronologically — newest first; over time an ad moves down the list (unlike rental and service listings, which rotate). The User may choose sorting by price. Paid Boosts affect an ad's position and appearance — boosted ads are marked; details in § 3a.
- Contact. Contacting the Author requires being logged in. Conversations take place via LocaYo chat; when posting an ad, the Author chooses whether to additionally share a phone number or an e-mail address. We reveal these details only to logged-in Users after they click "Show number" / "Show e-mail"; the number of reveals is limited and counted. The ban on placing contact details in the content and on photos (§ 7 para. 4) applies here too.
- Reports. Any Local classified ad can be reported with the "Report this ad" button. Reports are handled by a moderator; we inform the reporting person of the outcome.
- Suspended or deleted Account. Suspension of an Account pauses the User's Local classified ads, restoring the Account restores them, and deletion of the Account removes them permanently.
- Food. A seller of food is responsible for ensuring that the sale meets the requirements of food law, including sanitary and veterinary requirements, and for correct product labelling. LocaYo does not check the quality or safety of food.
8. Bookings and Transactions
- Customers may request bookings through the Platform. Providers may accept or decline requests.
- Once a booking is confirmed, both parties enter into a direct agreement with each other. LocaYo is not a party to this agreement.
- Payment for rentals and services is arranged directly between Provider and Customer. LocaYo does not process, hold, or intermediate any payments between Users for rentals or services.
- Cancellation policies are set by individual Providers and displayed on their listings. Users should review these before booking.
- We encourage Users to communicate through our platform messaging system for their protection and records.
- Any disputes regarding bookings, payments, or service quality are between the Provider and Customer. While we may offer assistance, we are not obligated to mediate or resolve disputes.
8.7 User-to-User Data Sharing
- When you confirm a booking, you may need to share contact information (such as phone number or address) directly with the other party to facilitate pickup or delivery.
- We recommend:
- Using our in-app messaging system where possible
- Providing a meeting point or approximate address rather than exact home address
- Only sharing contact details after booking confirmation
- LocaYo is not responsible for how other Users handle personal information you share with them outside our Platform.
- If you believe another User has misused your personal information, please report this to us immediately and consider contacting your local data protection authority.
8a. Provider Tools: Client Base, Schedule and Team
- The dashboard gives the Provider tools for running their own business: a client base, an appointment schedule (including appointments arranged outside the Platform), return reminders and team accounts. Using them is optional.
- The Provider is the controller of the client data entered into the base. LocaYo processes that data solely as a processor within the meaning of Art. 28 GDPR — on the Provider's documented instructions and only in order to supply the tools described here.
- Conclusion of the processing agreement. Before adding the first client, the Provider accepts an in-app notice about entrusting the data. Acceptance constitutes a data processing agreement with the content set out in this section. Without it the feature stays unavailable. The date and version of the acceptance are recorded.
- Scope of the entrustment (Art. 28(3) GDPR):
- Subject matter and purpose: storing the Provider's client data and making it available to the Provider in the dashboard, running the schedule, recurring appointments and reminders.
- Duration: for as long as the tools are used — until the client card is deleted, use ceases, or the Provider's account is deleted (the data is erased once the 14-day grace period has passed).
- Nature of processing: storage, organisation, display in the dashboard, export at the Provider's request, and sending reminders to the Provider themselves (never to their clients).
- Type of data: name, contact details (phone, e-mail), notes and markers entered by the Provider (including warnings about cooperation), tags, and the history of appointments, bookings and jobs.
- Categories of data subjects: the Provider's clients — both those holding a LocaYo account and people added manually who have none.
- LocaYo's obligations as processor. LocaYo: processes the data only on the Provider's instructions; does not use it for its own purposes, in particular marketing or analytics; does not disclose it to other Users; ensures that persons authorised to process it are bound by confidentiality; applies security measures meeting Art. 32 GDPR; assists the Provider in responding to data subject requests and in meeting the obligations under Art. 32–36 GDPR; and makes available the information needed to demonstrate compliance. This data is not accessible in the LocaYo admin panel — technical access is limited to staff maintaining the infrastructure, to the extent necessary to operate the Platform.
- Sub-processing. The Provider grants general authorisation for LocaYo to use the sub-processors listed in the Privacy Policy (in particular hosting and database services within the EU). We give advance notice of any intended change of sub-processor; the Provider may then stop using the tool and export the data.
- Provider's rights. The Provider may export the entire base to a CSV file at any time and delete individual cards. Deleting the account removes the whole client base and schedule.
- Provider's obligations. The Provider ensures a legal basis for processing their clients' data and fulfils the information duty towards them (Art. 13–14 GDPR). Only data necessary to deliver the service may be entered. Special categories of data must not be entered (Art. 9 GDPR), in particular health data, nor data on criminal convictions.
- Team. The Provider may grant access to their account to other people (the "Team") — the number depends on the chosen plan — assigning them a role (Owner, Manager, Employee) and individual permissions. The access each role gives is described in the dashboard, under Team.
- Team members act in the name and on behalf of the Provider. The Provider is responsible for their actions as for their own and must authorise them to process personal data (Art. 29 GDPR) and bind them to confidentiality. A team member's access to the Provider's client data results from the Provider's own decision and can be withdrawn by them at any time.
- Manually entered appointments are agreements concluded outside the Platform. LocaYo does not intermediate in them and does not report them to tax authorities under DAC7 (Section 3).
8b. Document Templates, Receipts and Bills
- In the panel, a User can download contract and protocol templates and issue a receipt or a simple bill (without VAT). Using these tools is optional. LocaYo does not issue VAT invoices and does not send documents to KSeF (the Polish National e-Invoicing System).
- Templates are for illustration only and do not constitute legal, tax or accounting advice. The parties to a document are the persons named in it — LocaYo is not a party and does not review its content.
- The issuer is responsible for the content of the document, the choice of its type and any resulting tax obligations. General tax information — Section 5.3.
- A receipt or bill is created at the moment it is issued: the User downloads the PDF file or asks us to send it by e-mail to an address the User provides. LocaYo does not store issued documents or their recipients' data.
9. Premium Features and Boosts
- LocaYo may offer optional paid features such as Boosts, which increase the visibility of Listings on the Platform. Businesses may also buy a plan (Bronze, Silver, Gold) as a monthly subscription. The scope of each plan — the number of rental and service listings, team accounts and included highlights, and the discount on extra boosts — is set out in the price list on the business page and in the panel (Plan and payments); the scope shown at the time of purchase applies. Local classifieds (Section 7b) do not count towards plan limits.
- Payments for premium features are processed by our payment provider, Stripe. By purchasing a Boost or other premium feature, you agree to Stripe's terms of service.
- Pricing and VAT. Prices for premium features are displayed on the Platform and include applicable taxes. For EU customers, VAT is charged at the rate applicable in your country of residence in accordance with EU VAT rules.
- Right of withdrawal (consumers).
If you are a consumer (a natural person acting outside your trade, business, craft or profession), you have the right to withdraw from a contract for premium features within 14 days of its conclusion, without giving any reason and without incurring any costs (subject to letter b below).
- a) How to withdraw. To exercise your right of withdrawal, inform us by an unequivocal statement: by e-mail to [email protected] or by post to the registered office address indicated in § 1. You may use our model withdrawal form but you are not required to do so. To meet the deadline it is sufficient that you send your statement before the 14-day period expires.
- b) Exception — loss of right of withdrawal (digital services performed with consent). Pursuant to Article 16(m) of Directive 2011/83/EU (and equivalent national provisions, e.g. Polish Consumer Rights Act art. 38 pt 13, Estonian Võlaõigusseadus § 53(4)(11)), the right of withdrawal does not apply if:
- performance of the service has begun (e.g. a boost has been activated or a premium feature unlocked) with your prior express consent before the 14-day period expires, and
- you were informed before the purchase about the loss of the right of withdrawal in such case.
- c) Exception — short-term accommodation rentals. Pursuant to Article 16(l) of Directive 2011/83/EU (Polish Consumer Rights Act art. 38 pt 12), the right of withdrawal does not apply to contracts for the provision of accommodation services (other than for residential purposes) provided on a specific date or for a specific period. This concerns direct booking contracts between Customer and Provider — however, since LocaYo is not a party to that contract and does not intermediate payments (§ 3, § 8), refund rules are set directly by the Provider in the listing's cancellation policy.
- d) Effects of withdrawal. Upon receipt of your statement, we will reimburse all payments received from you without undue delay and not later than 14 days after we are informed of your decision, using the same means of payment as you used for the initial transaction (unless you expressly agree otherwise). If you expressly requested that performance begin before the 14-day period expires and then withdraw, we may deduct a proportionate amount for the service rendered up to the day of withdrawal, in accordance with Article 14(3) of Directive 2011/83/EU.
- Pricing transparency and promotions (Omnibus Directive 2019/2161). Whenever the price of a premium feature is reduced, we display next to the current price the lowest price of that feature applied on the Platform during the 30 days preceding the reduction, in accordance with Article 6a of Directive 98/6/EC as amended by Directive 2019/2161 (transposed locally e.g. in the Polish Act on the Information of Prices of Goods and Services of 9 May 2014). For features offered for less than 30 days, we display the lowest price since the start of the offering. Introductory promotions (first 30 days after a feature launches) are clearly labelled as „introductory price".
- No guarantee of results. Purchasing a Boost increases visibility but does not guarantee bookings, enquiries, or any specific outcome.
- Complaints. If a premium feature does not work as described or a technical fault occurs, contact us through our Help Centre. We respond to complaints within 14 days of receipt.
10. Delivery Services
- Some Providers offer delivery or collection services for rented items.
- Delivery terms, costs, and areas are set by individual Providers.
- LocaYo does not provide delivery services. Any delivery is arranged directly between Provider and Customer.
- Providers who offer delivery are responsible for ensuring safe transport of items.
11. Reviews and Ratings
- Users may leave reviews and ratings after completed bookings and after completed job-board orders. For job-board orders, reviews are two-way — both the Client and the Service Provider may rate each other once completion is confirmed.
- Review authenticity (Omnibus Directive 2019/2161, Article 6a). We accept and publish reviews only from Users who have completed a transaction through the Platform — each review is linked to a specific, confirmed booking or completed job-board order in our system. Every published review is labelled „Verified" (confirming it stems from a completed transaction on the Platform). We do not publish reviews without an associated booking or order, we do not buy or incentivise the buying of fake reviews, and we do not remove negative reviews in exchange for compensation. Reviews are sorted by default from newest; the rated User cannot manually hide unfavourable reviews.
- Reviews must be honest, accurate, and based on genuine experiences.
- Prohibited review content includes:
- False or misleading statements
- Defamatory, abusive, or discriminatory content
- Personal attacks or threats
- Spam or promotional content
- Content violating privacy
- We may remove reviews that violate these Terms.
- Providers may respond to reviews publicly.
12. Intellectual Property
- The Platform, including its design, features, content, and software, is owned by LocaYo and protected by intellectual property laws.
- Users retain ownership of content they upload but grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content on the Platform.
- You may not copy, modify, distribute, or create derivative works from our Platform without permission.
- The LocaYo name, logo, and branding are our trademarks and may not be used without authorisation.
13. Limitation of Liability
- The Platform is provided "as is" without warranties of any kind, except as required by law.
- To the maximum extent permitted by law, LocaYo is not liable for:
- The conduct of any User
- The quality, safety, or legality of any listings
- Any transaction between Users
- Loss or damage to rented items
- Personal injury arising from use of items or services
- Any indirect, incidental, or consequential damages
- Our total liability to you shall not exceed the amounts you have paid to us (if any) in the 12 months preceding the claim.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
- UK consumers: You have legal rights under the Consumer Rights Act 2015 and other consumer protection legislation that cannot be excluded or restricted by these Terms.
- EU/EEA consumers: You have rights under the Consumer Rights Directive (2011/83/EU) and other applicable consumer protection laws that cannot be excluded.
14. Indemnification
- You agree to indemnify and hold LocaYo harmless from any claims, damages, losses, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of third parties
- Any transaction with other Users
- Content you submit to the Platform
- Your failure to provide accurate tax compliance information as required under Section 5.3
- This indemnification does not apply to the extent that the claim arose from our own negligence or breach of these Terms.
15. Account Suspension and Termination
- We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for us
- Receive multiple complaints from other Users
- Fail to pay amounts owed (where applicable)
- Fail to provide required tax compliance information after the notice period described in Section 5.3
- Register in breach of Section 5.1 (disposable inbox, fictitious details, multiple accounts), collect data from the Platform by automated means, or send other Users content intended to obtain data or money by deception (phishing)
- We also protect Users from abuse automatically: we reject disposable e-mail addresses, limit the number of accounts created from a single connection, do not deliver messages with links to external websites, and flag for review accounts created in series from one device. A human decides on suspending or deleting an account. We may delete an account that breaches Section 5.1 without prior notice; we inform you of the decision and the reason at the account's e-mail address, and you can appeal through the contact form.
- You may terminate your account at any time through account settings.
- Once you request deletion, your business profile, listings and job requests stop being visible immediately, and we erase the data after 14 days. Until that date you can restore the account by simply logging in as usual. After that date the deletion is irreversible.
- Upon termination, your right to use the Platform ceases immediately.
- Provisions that by their nature should survive termination will continue to apply, including Sections 5.3 (tax compliance data obligations), 12 (intellectual property), 13 (limitation of liability), and 14 (indemnification).
16. Dispute Resolution
- We encourage Users to resolve disputes directly with each other first.
- For disputes with LocaYo, please contact us first through our Help Centre to attempt informal resolution.
- EU and UK consumers: The EU Online Dispute Resolution (ODR) platform was shut down on 20 July 2025. You may instead use an alternative dispute resolution body in your country of residence — national consumer protection authorities maintain the applicable lists.
- Polish consumers: You may also contact the Polish Trade Inspection (Inspekcja Handlowa) or use the platform at uokik.gov.pl
- Nothing prevents you from bringing proceedings in court.
17. Changes to Terms
- We may modify these Terms at any time. Material changes will be notified via email or prominent notice on the Platform at least 15 days before taking effect. This notice period does not apply to changes we have to make immediately because the law requires it or to protect Users and the Platform from fraud, spam or other security threats — we will inform you of such a change without delay.
- Continued use of the Platform after changes constitutes acceptance of the modified Terms.
- If you do not agree to changes, you may terminate your account before they take effect.
- The current version of Terms is always available on the Platform.
18. Governing Law and Jurisdiction
- These Terms are primarily governed by the laws of the Republic of Estonia, as the Platform is operated by a company registered in Estonia.
- Disputes will be subject to the non-exclusive jurisdiction of the courts of the Republic of Estonia (Harju County Court). You may also submit a complaint to the Estonian Consumer Protection and Technical Regulatory Authority (TTJA) at ttja.ee.
- For EU/EEA users: you may bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights under mandatory consumer protection laws of your country of residence.
- If you are a consumer, you retain any mandatory consumer protection rights granted by the law of your country of residence, including rights under the Consumer Rights Directive (2011/83/EU) and the Polish Consumer Rights Act (Ustawa o prawach konsumenta) where applicable.
- If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
